How does one overcome a complainant’s fear of pursuing a harassment allegation, whilst protecting the sanctity of the alleged perpetrator being innocent until proven guilty?

The Code of Good Practice on the prevention and elimination of harassment in the workplace (“the Code”) that was gazetted on 18 March 2022 has repealed the 2005 Code of Good Practice on the Handling of Sexual Harassment Cases in the Workplace. Although the Code covers harassment generally as a form of discrimination, it has a section specifically focusing on sexual harassment. 

The Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace was gazetted on 18 March 2022. In this article we discuss whether the harassment codes go far enough, how to test for harassment and what should you do if there is harassment in your workplace.
